What Exactly Have You Been Charged With?
While the terms DUI and driving while intoxicated (DWI) are frequently used, these are not the actual names of drunk driving charges in Michigan. Instead, there are four drunk driving offenses:
- Operating while impaired (OWI)
- Operating under the influence of intoxicating liquor (OUIL)
- Driving with an unlawful bodily alcohol level (UBAL), also referred to as Driving with an unlawful bodily alcohol content (UBAC)
- Under age 21 operating with any bodily alcohol content
The Penalties for Drunk Driving
Michigan does not go easy on people accused of drunk driving. Even on a first offense, an OWI conviction will result in a maximum sentence up to $300.00 in fines plus costs, up to 93 days in jail and up to 45 days of community service. The penalties for OUIL and UBAL/UBAC are similar, except that you could face up to $500.00 in fines plus costs. Of course, convictions will also result in loss of drivers license. The length of drivers license loss varies based on the circumstances.
