Making Them Pay for Their Delay

If more than 30 days have passed and your workers' comp benefits claim has not been paid or denied, our lawyers will see that your employer pays for the delay. In these situations, you are entitled to a payment of 50 dollars a day for up to 30 days, for a total of 1500 dollars. This is in addition to any benefits you are granted.

Handling Denied Workers' Comp Benefits

Unfortunately, you may wait for your workers' comp claim to be paid, only to find out that your benefits have been denied. This is not where the process stops. In fact, this is where our work really begins.

We will dispute the denial. The case will be assigned to a workers' comp magistrate. A pretrial will be scheduled, at which we will review our case with the defense lawyer representing your employer and the workers' comp insurance company. A trial date will be set and we will prepare to make your case in front of the magistrate.

While waiting for the trial, we will work with you to see that you get the medical care you need. We will make certain that you are seeing trustworthy doctors who can help you get better, because recovery is obviously a priority. We also want to make certain that the doctors who treat you keep clear records, so we can bring that documentation to the trial.
